We represent both business and individual clients in all aspects of tax- corporate and individual tax as well as VAT and other indirect taxes.

We regularly advise and represent on:

  • Tax Disputes: pre-litigation strategy- advice on the merits; settlement negotiations with Kenya Revenue Authority (KRA); advocacy before the Tax Appeals Tribunal and Court hearings (appeals, judicial review) as well as, alternative dispute resolution.

Recent Representations:

  • Advising & acting for a leading manufacturer on assessments by Kenya Revenue Authority of Kshs 24 billion in respect of excise duty, VAT, penalties and interest before the Tax Appeals Tribunal as well as additional potential proceedings against the Cabinet Secretary for Interior.
  • Successfully represented a mining company in an appeal against VAT, Withholding Tax and Corporation Tax (resulting from an intercompany transaction) assessment at the Tax Appeals Tribunal resulting in a saving of more than Kshs. 1 Billion.
  • Successfully represented an international petroleum company and its related companies in an income tax appeal that involved a trademark dispute at the High Court resulting in a saving of Kshs. 800 Million.
  • Successfully represented a real estate company in an appeal with an income tax aspect at the Court of Appeal resulting in a saving Kshs. 600 Million.
  • Successfully represented an international petroleum company in a constitutional petition against a customs duty assessment of around Kshs.150 Million.
  • Successfully negotiated with the KRA in a VAT and Excise Duty tax assessment on behalf of a manufacturing company resulting in a saving of around Kshs. 500 Million
  • Successfully represented KRA in an appeal against a manufacturing company for Excise Duty assessment, at the Court of Appeal amounting to Kshs.440 Million.
  • Successfully negotiated a settlement with the KRA in a Customs Duty dispute on behalf of a social enterprise resulting in a saving of around Kshs.30 Million.
  • Successfully represented a downstream petroleum company in judicial review proceedings challenging a Customs Duty assessment of Kshs.169 Million.
  • Successfully represented a logistics company in an appeal against VAT assessment at the High Court resulting in a saving of more than Kshs.150 Million.
  • Successfully negotiated with the KRA in a VAT and Corporation Tax assessment on behalf of two related textile manufacturing companies resulting in a saving of around Kshs. 50 Million.
  • Advised a Kenyan company on the tax aspects of their shares, restructuring and group reorganisations in regard to significant capital investment by global private equity investors
